Fay took “health leave for a heart condition” in 1988; worked as a real estate agent. A woman filed suit in 12/2002 alleging that he abused her as a teen in the 1970s. Said he provided her and others with alcohol and marijuana. Settled in 2003. Per files released in 2/2003, the church knew in 1980 that Fay had been arrested in New Hampshire for “drunkenness and use of narcotics” and there were other allegations of misbehavior with youths. Involuntary laicization announced 2/12/2005. Included in 8/2011 on the Boston archdiocese’s list of accused. Settlement in 3/2023 in the high five figures of a claim that Fay sexually abused a boy, ages 8-12 during 1974-1978, while assigned to Incarnation Parish in Melrose. The abuse allegedly occurred in the parish rectory, in a small house behind the church used for CCD classes, and in a trailer in New Hampshire. Fay died in 2009.
