	Former Diocese Official to Get Jury Trial for Sexual Misconduct KOLD August 16, 2006 http://www.kold.com/Global/story.asp?S=5286837 Phoenix The former vicar general of the Roman Catholic Diocese of Phoenix will be allowed to have a jury hear his trial for sexual misconduct. Monsignor Dale Fushek is accused of having sexually related discussions during confessions with teenagers. Fushek also is accused of exposing himself to teens as he got into a hot tub. Typically, defendants accused of petty offenses don't have a right to a jury trial in Arizona. But Superior Court Judge Douglas Rayes says Fushek meets special guidelines for a jury since he faces the possibility of registering as a sex offender if convicted. Prosecutors say they will appeal Rayes' decision. No trial date has been set.
