Judge to Hear Appeal in Former Pastor's Trial The Arizona Republic June 8, 2006 http://www.azcentral.com/arizonarepublic/local/articles/0608evbriefs0608.html MESA - Suspended Monsignor Dale Fushek's appeal of a justice of the peace's decision to deny him a jury trial on six of seven misdemeanor sex counts is advancing in Maricopa County Superior Court. Judge Douglas Rayes, who will hear the appeal, will meet with prosecutors and defense attorneys for a telephone hearing on June 19. A date for arguments on the issue is expected to be set then. Fushek is the former pastor of St. Timothy's Catholic Church in Mesa. His lawyer, Thomas Hoidal, is challenging San Tan Justice of the Peace Sam Goodman's decision to deny Fushek a jury trial. Fushek, 53, is accused of five counts of contributing to the delinquency of a minor, one count of indecent exposure and one count of assault. Attorneys want charges dismissed in Mesa case MESA - Defense attorneys for murder defendant William Craig Miller asked a judge to dismiss the charges or remand the case to a new grand jury. Attorneys Phil Noland and Carmen Fischer argue that prosecutors presented no evidence to the grand jury that Miller acted with an accomplice in the Feb. 21 murders in east Mesa. "The presentation of Mr. Miller's case was unfair because grand jurors did not require the state to present any evidence, let alone evidence to establish probable cause, that Mr. Miller violated the probable cause statutes," the motion reads. Miller, 29, of Scottsdale, is accused of killing Steven Duffy, 30; his brother Shane Duffy, 18; his girlfriend, Tammy Lovell, 32; and her children, Jacob, 10; and Cassandra, 15. Court documents show police were told that Miller offered one man $50,000 and a second $15,000 to kill Steven Duffy to prevent him from testifying against Miller. Carwash aims to fund memorial for slain teen QUEEN CREEK - Friends and family of the 15-year-old girl shot to death at a Gilbert home will hold a carwash Sunday to raise money for her memorial. Lyndsey Miles of Queen Creek was shot Sunday at a friend's home. Michael Craig Lance, 40, who rented a room in the house, was arrested. The carwash will be from 9 a.m. to 2 p.m. at Native New Yorker, 23706 S. Power Road. Donations to the Lyndsey Miles Memorial Fund can also be made at any Wells Fargo bank location. 19-year-old shot dead inside his Mesa home MESA - Police were investigating the death of a 19-year-old man as a homicide Wednesday. The man was shot about 5 p.m. at the home he shared with his mother near Ellsworth and Brown roads. His mother told police she was outside when she heard a gunshot and went inside to find her son. Police said a weapon was not found during an initial search. |
