Another Chapter in Where in the World was Donald McGuire SJ – Hawaii
This time at WTK we begin with a picture and not a document. In an image worth a thousand words and possibly millions more in monetary damages for victims, we have Donald McGuire SJ in Honolulu, Hawaii circa 2003. He was already under strict supervision from Chicago at the time of the picture and had to provide itineraries to his superiors for approval of travel. We don't know if any young male "assistants" accompanied him to the sandy beaches of Honolulu, yet. Or if this was his only trip there? As WTK reported earlier McGuire's good friend and fellow sued abuser Bishop Joseph Sullivan of Baton Rouge was subject to a lawsuit in Hawaii in 2005.
Good Bye Statute of Limitations for Jesuit Abuse?
Donald McGuire SJ is now a very interesting legal problem for the Chicago Province of the Society of Jesus. For nearly the last decade the Chicago Jesuits and their attorneys, the best donated dollars can buy, have fought McGuire victims arguing most abuse fell outside the antiquated Statute of Limitations (laws limiting the time when a lawsuit can be brought). Even though the Jesuits had been actively defrauding McGuire's victims and allegedly perjuring themselves well into 2009 (more later), the attorneys for the Order claimed they were not liable because the abuse happened so long ago. The last documented incident in 2004.
In June 2012 the State of Hawaii took the brave step of revising their Statue of Limitations for abuse and opening a 2 year window for survivors to come forward, regardless of when the abuse occurred. "The law provides victims who have been unable to file civil lawsuits because the statute of limitations has expired a two-year window — or until April 2014 — to go to court. Victims can sue their alleged abusers and churches, community groups or businesses that were grossly negligent at preventing sexual misconduct."
SB 2588 SD1 extends the statute of limitations (SOL) for civil actions brought by persons subjected to sexual offenses as a minor against the person who committed the act. It increases the time limit to bring these civil lawsuits going forward as follows: 8 years from when the victim turns 18, or 3 years from when the victim realizes his/her injury is due to sexual offense. (Note: Previous law was 2 years in both instances).
The bill also revives for a 2 year period for certain actions for which the statute of limitations had previously lapsed.
This change in the law has already revived some cases from the 1970s. What will be interesting to see is if McGuire's authorized trip to Hawaii would help a plaintiff avail themselves of the State's open window? Can the Jesuits spell diversity jurisdiction? Or maybe their lawyers have heard of sufficient minimum contacts? It would seem sending a known child abuser into a state, the Jesuits "could reasonably expect to be haled into court" in that state? We don't know how to give legal advice, so check somewhere else.
