  Cleric Freed after Found Innocent of Abusing Boy

The Moshi Resident Magistrate’s Court in Moshi Rural District has freed Kilema Catholic priest Fr Stanslaus Sala after he was found not guilty in a sexual abuse case involving a 16-year-old boy.

The decision was reached by resident magistrate in charge Simon Kobelo after listening to prosecution witnesses, including the father of the boy and the St Theresa parish guard in Kilema area.

Kobelo said the defendant had no case to answer due to fact that the plaintiff failed to bring the child, who was abused, the doctor who investigated the matter and a PF3 showing that the crime was reported to the police and the child treated at a hospital.

“Apart from the allegations and the four witnesses brought before this court, the boy who, was is claimed to have been abused, who is the complainant, has not been brought before the court to present his witness and the doctor, who investigated him. There is also no PF3. So, the court has freed the accused under section 239 of the Criminal Procedures Act,” Kobelo said.

Testifying in the court, the father Amathy Lyamuya said he did not check his son and never knew his son had been sexually abused but was just forced to go to report to the police concerning the matter.

The guard of the parish, Paul Munga, claimed he did not see the priest abusing the boy either.

In previous hearings in the court, it was claimed that contrary to section 154 (1)(a) (Cap 16) of the Penal Code (R.E. 2002), the defendant sexually abused the boy, who was a livestock keeper at the parish.

It was claimed that the incident happened on October 30, this year, at 20:00, while the boy was sleeping in his room.
