SYRACUSE, N.Y. (AP) — A prosecutor frustrated over his inability to get records from police about an investigation into a Syracuse University assistant basketball coach accused of molesting ball boys now has a subpoena.

Onondaga County District Attorney William Fitzpatrick says police have yet to honor a subpoena seeking records about the investigation into Bernie Fine. But Fitzpatrick told the Post-Standard of Syracuse (http://bit.ly/up1fXa ) that the records will be provided.

Two former ball boys have claimed they were molested more than 25 years ago by Fine, who is on paid leave from the university. Fine says the charges are false.

Fitzpatrick says he took the unusual step of getting a subpoena from a judge after police refused requests for information.

Syracuse Mayor Stephanie Miner says no information would be shared until police complete their investigation.
