  Judge Delays Bevilacqua Competency Hearing

A PHILADELPHIA judge yesterday postponed until October a hearing to determine whether former Cardinal Anthony Bevilacqua is competent to testify in a priest-abuse case.

Bevilacqua, 88, was expected to be in court next week to see if he was fit to testify in the case against Monsignor William Lynn, one of his former aides. Lynn, 60, is accused of covering up clergy sex abuse by simply transferring abusive priests. He's scheduled for trial in March.

Church lawyers say Bevilacqua, who retired in 2003, has cancer and suffers from dementia. Common Pleas Judge Teresa Sarmina did not give a reason for the schedule change. The new hearing will be Oct. 19.

Meanwhile, lawyers for Lynn asked Sarmina yesterday to dismiss the charges against the monsignor or move his trial because of publicity.

Lynn's lawyers also asked that the judge remove a gag order that they say is hurting their client, the Inquirer reported.
