  Judge: Mexican Man Can File Clergy Suit in US

A federal judge won't dismiss a lawsuit filed against the Roman Catholic Archdiocese of Los Angeles by a Mexican national using a law enacted in 1789.

U.S. District Judge Josephine Staton Tucker on Friday denied a dismissal motion by church attorneys who argued that U.S. courts did not have jurisdiction.

The lawsuit uses the 222-year-old Alien Tort Claims Act to sue recently retired Los Angeles Cardinal Roger Mahony and his Mexican counterpart on behalf of a Mexico City man who claims he was abused in Mexico by a Mexican priest.

The lawsuit alleges that abuse happened after the priest fled a brief assignment in Los Angeles, where he was also accused of molestation.

Church attorney Mike Hennigan says the case has no merit and will ultimately be dismissed.
