	Ex-Priest Fights Being Labeled 'Sexually Violent Person' By Manya Brachear Chicago Breaking News November 19, 2009 http://www.chicagobreakingnews.com/2009/11/lawyers-ex-priest-should-not-be-labeled-a-sexually-violent-person.html Attorneys for a former priest convicted of sexually abusing five boys at his West Side parish filed a motion today fighting efforts by the state to label him a sexually violent person. Daniel McCormack served more than two years of a five-year prison term for sexually abusing five boys in the rectory of St. Agatha Roman Catholic Church. Shortly before his parole in September, Cook County prosecutors and the Illinois attorney general filed a joint petition to have McCormack confined to a state treatment facility under the Sexually Violent Persons Commitment Act. Illinois law allows prosecutors to seek continued incarceration if a psychological exam leads them to believe another sex crime is likely if the inmate goes free. In September, a forensic psychiatrist hired by the attorney general diagnosed McCormack with pedophilia and recommended civil commitment. But in the defense motion filed Thursday, attorney Daniel Coyne, a professor at Chicago-Kent College of Law, argued that the Illinois Department of Corrections should have hired the psychiatrist, not the attorney general. It also points out that another psychiatrist hired by prosecutors in August did not recommend McCormack for civil commitment. The state's attorney and attorney general offices are expected to argue against McCormack's motion Dec. 17. McCormack, 41, was removed from the priesthood by Vatican decree in 2007.
