The retired 83-year-old Roman Catholic Priest, who is partially blind, had argued that his right to a fair trial had been breached by the delay in making the complaints. The offences allegedly occurred in his home in 1977 and 1978 - the alleged victim made a formal complaint to Gardai in 2006 with charges brought against the priest in 2007. Today the High Court said the loss of the evidence of the complainant's mother in relation to the case as well as the priest's blindness and the state of his general health warranted prohibiting the trial. |
