State Appeals FLDS Ruling By Chuck Lindell Austin American-Statesman May 23, 2008 http://www.statesman.com/blogs/content/shared-gen/blogs/austin/politics/entries/2008/05/23/state_appeals_flds_ruling.html Child-welfare officials are asking the Texas Supreme Court to overturn an order to begin returning children to the polygamist sect's ranch near Eldorado. On Thursday, the Third Court of Appeals in Austin ruled that Child Protective Services failed to prove that children on the YFZ Ranch were in imminent danger of physical harm when they were separated from their parents in April and sent to foster homes across Texas. Their parents belong to the Fundamentalist Church of Jesus Christ of Latter Day Saints, a breakaway Mormon sect. In its filing Friday, the Department of Family and Protective Services, which includes CPS, also asked the Supreme Court to issue an emergency stay halting enforcement of the Third Court's decision. "Not only will (the department) suffer irreparable harm if this is allowed to stand, but the subject children will be at risk of sexual and emotional abuse. This, certainly, is not in the children's best interest," the request for a stay reads. |
