Appeals Court: Diocese Can't Be Sued for Priest Molestation Associated Press, carried in Chicago Tribune May 20, 2008 http://www.chicagotribune.com/news/chi-ap-wi-churchabuse,0,1426941.story WAUSAU, Wis. - A state appeals court has ruled against a man who sued the Roman Catholic Diocese of Green Bay for damages over his molestation by a priest in 1988. The three-judge panel rejected David Schauer's contentions that errors were made in a trial that concluded the diocese couldn't be sued because the statute of limitations had expired. Schauer was molested as a 10-year-old student at Saints Peter and Paul Catholic School in Green Bay, where Donald Buzanowski was assigned as a priest at the time. Schauer sued Buzanowski, the diocese, the school and their insurers in 2003. A Brown County judge dismissed the suit but the appeals court revived it in 2005 to determine whether diocese officials improperly discouraged him from filing it with their actions in 1990. |
