Casal di Principe. Una località segreta, mantenuta tale dal muro di silenzi alzato da una comunità ecclesiastica, ma i guai giudiziari nei quali DON MARCO CERULLO si è cacciato per una storia di presunti abusi su un suo alunno, potrebbero raggiungerlo anche lì, nel luogo segreto in cui il viceparroco sconta gli arresti domiciliari circondato da sacerdoti che hanno offerto di ospitarlo. Perché dopo quasi due mesi dal suo arresto il pm della procura di Santa Maria Capua Vetere Antonio Ricci sta per avanzare la richiesta di incidente probatorio. Non potrebbe fare altrimenti. È previsto infatti che per i delitti sessuali o a sfondo sessuale il pubblico ministero o la persona sottoposta alle indagini debbano chiedere che si proceda con incidente probatorio all'assunzione della testimonianza di persona minorenne. Costantino Puocci, aveva avanzato l'istanza il 24 dicembre del 2007, ma il pm ha ritenuto opportuno valutare prima lo stato psicologico della vittima. Un passo prudente e graduale prima di acquisire tutte le prove di una triste e spiacevole verità. Diversa la posizione dell'avvocato Carmine Ucciero, legale di don Marco che non ha escluso che dopo aver ricevuto gli atti inviati al Riesame possa chiedere il rito abbreviato. Ciò comporterebbe l'ammissione di colpa di don Marco che davanti ai carabinieri che lo avevano colto in flagranza di reato il 19 dicembre scorso, aveva ammesso l'abuso scoppiando in lacrime, ma ascoltato dal gip aveva ritratto dicendo che il suo «era solo un abbraccio affettuoso». Quegli abbracci, altri abbracci di don Marco ad altri alunni o ragazzi della parrocchia, i militari di Casal Di Principe hanno smesso di cercarli. Le perquisizioni in chiesa e in alloggio hanno dato esito negativo e con esso sono svanite anche le speranze che ulteriori denunce potessero giungere in caserma. Un altro muro alzato da sfondare, anche questo fatto di silenzi. In caso di rito abbreviato l'ex viceparroco potrebbe ottenere lo sconto della pena di un terzo, pena che va da un minimo di sei ad un massimo di dodici anni di reclusione; con le attenuanti generiche prevalenti il minimo potrebbe scendere a cinque anni. Anni durante i quali don Marco potrebbe anche non vedere mai le grate del carcere. Il fascicolo degli atti, con il rito abbreviato, potrebbe passare nelle mani di Francesco Chiaromonte. La vicenda giudiziaria e le ipotesi sullo sviluppo del caso s'intrecciano con la sorte della parrocchia del Santissimo Salvatore di Casal Di Principe. Perché da circa due mesi la chiesa non ha un viceparroco, ma è retta da don Carlo Aversano, rimasto solo e ancora addolorato per quanto accaduto. Sarebbe stato invece sostituito l'insegnate di religione cattolica nella scuola media ed elementare di Villa Literno. Dal plesso scolastico l'alunno, senza l'autorizzazione dei genitori, non sarebbe dovuto uscire, perché il permesso ratificato dal vicedirigente aveva accordato solo lo spostamento da un'aula all'altra per realizzare il «progetto Natale». Da questa circostanza sarebbe nata la querela di parte contro don Marco perché «approfittando del suo ruolo di sacerdote nonché di insegnante di religione», portò via il ragazzino «per condurlo, con un raggiro, in una zona periferica della città per poi costringerlo a subire abusi di tipo sessuale».

A secret location, protected by the silent wall raised by an ecclesiastical community. But the judiciary woes the Rev. Marco Cerullo is now facing for his alleged sexual abuses of one of his pupils could reach him even there, in that secret locality in which the vice parish priest is kept in house arrest, surrounded by those priests who offered him hospitality.

After almost two months after the arrest, prosecutor Antonio Ricci, in the locality of Santa Maria Capua Vetere, is now asking the judge to follow the procedure of the "incidente probatorio", which can be adopted in cases of sexual crimes committed against a minor who is also going to be called as a witness. In fact, the lawyer of the pupil's family, Costantino Puocci, asked to adopt that procedure on December 24, 2007, and the prosecutor had then deemed important to evaluate the psychological state of the victim. A prudent and gradual step before he could find all the evidence of a sad and unpleasant truth.

A different stance was taken by the Rev. Marco's lawyer, Carmine Ucciero, who didn't exclude asking for a trial with an abbreviated procedure once he had received a copy of all the official documents in possession of the judges. That would imply the admission of guilt by the Rev. Marco, who when he was caught by the carabinieri just when he was committing the crime on December 19, 2007, burst into crying and admitted being the author of sexual abuse against his pupil. But after he was interrogated by the judge for the preliminary investigations he recanted and said he "had only given the boy an affectionate hug".

The carabinieri have now stopped investigating those hugs and the additional ones the Rev. Marco might have given to other pupils or parish boys. The subsequent searches in the church and in the home of the priest didn't give any other results and that stopped the hopes that further allegations could reach the military police's barracks. That wall of silence didn't fall down.

If the abbreviated procedure will be adopted it could allow the priest a jail term discount of one third and the punishment could range between a minimum of six and a maximum of twelve years of jail; if the prevailing "generic mitigations" were applied the minimum penalty could be lowered to five years of jail. And there is even the eventuality the Rev. Marco would never see the jail bars. In case of abbreviated procedure all the papers could be transferred in the hands of prosecutor Francesco Chiaromonte.

The judiciary vicissitudes and the hypothesis on how this case is going to be shaped are intertwined with what is going to happen in the parish of the Santissimo Salvatore in Casal di Principe. For the last two months the church is deprived of a vice parish priest and it's run by the Rev. Carlo Aversano, who was left alone and still in pain for what had happened. Only the teacher of catholic religion in the elementary and middle school of Villa Literno seems to have been replaced.

The pupil who was the victim of sexual violence, without the permit of his parents, would have never been allowed to leave the premises of the school, for the permit given by the school's vice manager was only limited to the shift of the pupils from one class room to another in order to implement the "progetto Natale" (Christmas plan). That was the legal reason for which the lawsuit against the Rev. Marco started: "profiting from his role of priest and teacher of religion, he lead his pupil, using a stratagem, to a zone in the periphery of the city and abused him sexually".
