  Decisions Awaited in Former Priest's Case

SHEPHERDSVILLE, Ky. — A former Roman Catholic priest is out of prison and back in jail, but Daniel Clark may be free on bond soon.

Clark's sexual-abuse conviction was overturned by Kentucky's highest court and he was released from state prison yesterday and returned to the Bullitt County Jail.

Bullitt County Commonwealth's Attorney Mike Mann says a decision on whether he will be tried again should be made in the coming days. If the 59-year-old Clark gets a new trial, he's expected to be released on bond.

Clark was convicted in 2003 of two counts of first-degree sexual abuse for molesting two boys between 1999 and 2002. One of the boys was eight-years-old and the other was nine.

The Kentucky Supreme Court overturned the conviction last month, saying the trial judge gave faulty instructions to the jury and improperly allowed a former victim of Clark to testify. The court said that was prejudicial to Clark.
