Bujak's Attorney: Clergyman Plans to Plead Not Guilty on Two New Counts

An Elgin pastor accused of severely spanking a then 12-year-old girl now has a longer list of charges against him.

Rev. Daryl P. Bujak, 30, of the First Missionary Baptist Church at 385 Silver St., had two misdemeanor charges added in his case recently: one additional count of battery and one count of failure to comply with the duties of a mandated reporter.

The latter charge stems from Bujak's status as a clergyman, who are required by law to report possible sexual assaults to the Illinois Department of Children and Family Services when they have reasonable cause to believe that abuse of a minor has occurred. Other statutorily mandated reporters include teachers and guidance counselors.

According to authorities, between March and May 2005, Bujak used a large piece of wood molding to repeatedly spank the 12-year-old, leaving marks on her legs and buttocks. The girl's mother had brought the child to Bujak for counseling, because she didn't believe the girl's claims that the mother's boyfriend had sexually abused the girl.

The girl's mother went on to say she believed her daughter and regretted consenting to Bujak's spankings. The boyfriend, Matthew Resh, 33, of Ingleside, eventually was charged in May 2006 with assaulting the girl, and faces five felony counts of predatory criminal sexual assault in McHenry County. Resh has pleaded not guilty on all five counts, and his case still is in the pretrial stage, McHenry County State's Attorney Louis A. Bianchi said in a telephone interview Monday.

Bujak has not yet been arraigned on the two new charges, but Lisle-based defense attorney Ross Bartolotta -- who represents the pastor -- told The Courier News on Monday that Bujak plans to plead not guilty on the new misdemeanor counts. Bujak pleaded not guilty a year ago to the original misdemeanor battery charge.

Bujak has appeared at the main criminal courthouse on Illinois 38 in St. Charles Township, but his next appearance is scheduled for 9 a.m. June 29 in Elgin Branch Court.
