A victory for the Allentown diocese tonight in a priest abuse lawsuit already shot down once by a Berks County judge. The Pennsylvania Superior Court upheld Judge Jeffrey Schmehl's 2005 dismissal of a lawsuit that accused Reading Central Catholic High School of failing to prevent sexual abuse by its then-vice principal, Father James Gaffney. Diana Vojtasek claims Father Gaffney forced her to have sex with him when she was a student at Central Catholic in the early 90's. In the summer of 2005... Judge Schmehl dismissed the case.. saying Vojtasek waited too long to file her suit. Vojtasek's lawyer says they'll ask the state Superior Court to look at the case again.. If they won't.. he says an appeal will be filed with the State Supreme Court.
