Acting Justice WP Nagan said during sentence in the High Court that the 32-year-old victim had been so badly and wickedly assaulted that he was forced to conclude that Mbulelo Galimoya was guilty of attempted murder. The woman was stabbed so many times with a knife that, had she not received medical treatment in time, she would surely have died. One stab wound just missed her heart. The level of violence of the other stab wounds in her neck, showed that there was an attempt to commit murder. Galimoya, a married father of four, was earlier found guilty of rape, kidnapping and murder. "The kidnapping and murder of a baby is a despicable crime against a harmless infant. The accused showed no empathy towards his victims. We know the child is dead, but there is no evidence that his death was planned beforehand. However, the accuser must live with these memories for the rest of her life." Nagan said if Galimoya had given evidence it could have helped the court to find palpable and urgent circumstances that could possibly justify anything less than the prescribed minimum sentence. He said Galimoya, who stared straight ahead throughout the proceedings, to life imprisonment for the rape, 10 years for attempted murder, 20 years for murder and five for the kidnapping. The State put it that on the night of 10 and 11 December 2004, the accuser and her baby visited a friend's house in KTC camp, where they drank beer with Galimoya. Late that night her friend left the house with another friend. Galimoya closed the doors and began stabbing her with a knife until she lost consciousness. Galimoya then hit the baby on the head with a blunt object and buried his body on the rubbish heap. He was arrested after the accuser's friends identified him as the last person with her in the house. A doctor gave evidence that the accuser had also been raped during the assault.
